IN RE James Arthur KEARNS

From the 226th Judicial District Court, Bexar County, Texas Trial Court No. 2018CR11585 Honorable Velia J. Meza, Judge Presiding

Original Mandamus Proceeding

This proceeding arises out of Cause No. 2018CR11585, styled State of Texas v. James Arthur Kearns, pending in the 226th Judicial District Court, Bexar County, Texas, the Honorable Velia J. Meza presiding.

Sitting: Rebeca C. Martinez, Chief Justice, Luz Elena D. Chapa, Justice Liza A. Rodriguez, Justice

ORDER

PER CURIAM

On May 31, 2022, relator James Arthur Kearns filed a "Request for Stay of Lower Court Proceedings Petition for Writ of Mandamus and Petition for Writ of Prohibition." A stay of the underlying trial proceedings has been granted in a related proceeding before this court. After considering the petition and the record filed in this original proceeding, this court concludes Kearns did not show he is entitled to the relief sought. Accordingly, the petition for writ of mandamus and petition for writ of prohibition are DENIED. See Tex. R. App. P. 52.8(a). Kearns's request for stay is DENIED as moot.

See James Arthur Kearns v. The State of Texas, No. 04-22-00266-CR.

It is so ORDERED.
