On Appeal from the 313th District Court Harris County, Texas Trial Court Cause No. 2022-01753J
Panel Consists of Justices Hassan, Poissant, and Wilson.
ABATEMENT ORDER
PER CURIAM
This is an accelerated appeal from a judgment in a parental termination appeal. Appellant's brief was due December 18, 2023, but it has not been filed.
On December 19, 2023, this court ordered appointed counsel, Sara E. Bloome, to file a brief on or before December 29, 2023. No brief or motion for extension of time was filed. On January 2, 2024, counsel attempted to file a brief that was not in compliance with the rules. The clerk of this court gave counsel one day to file a compliant brief. As of today, no brief has been filed. Accordingly, we issue the following order:
We ORDER the judge of the 313th District Court to immediately appoint new appellate counsel for appellant on or before January 11, 2024. The judge shall see that a supplemental clerk's record with an order appointing new appellate counsel is made and shall order the trial clerk to file the supplemental clerk's record with this court by January 11, 2024.
The appeal is abated, treated as a closed case, and removed from this court's active docket. The appeal will be reinstated on this court's active docket when the trial court's order appointing new counsel has been filed. The court will also consider an appropriate motion to reinstate the appeal filed by either party, or the court may reinstate the appeal on its own motion.
