Due to clerical error, the order filed on September 25, 2024, is hereby amended in its entirety nunc pro tunc to include Justice Groban's vote to grant review as follows:
The petition for review is granted. The matter is transferred to the Court of Appeal, Fourth Appellate District, Division Two. That court is ordered to vacate its summary denial dated August 5, 2024, and is further ordered to issue an order to show cause, returnable before the Riverside County Superior Court. (Cal. Rules of Court, rule 8.528(d).) The Secretary of the Department of Corrections and Rehabilitation is ordered to show cause before the Riverside County Superior Court why petitioner is not entitled to appointment of counsel pursuant to Penal Code section 1473, subdivision (e), in light of data provided by petitioner demonstrating racial disparities in charging special circumstance murder in Riverside County.
