No. 11-10-00127-CV (Tex. App. Oct. 28, 2010)

Opinion

No. 11-10-00127-CV

Opinion filed October 28, 2010.

Original Mandamus Proceeding.

Panel consists of: WRIGHT, C.J., McCALL, J., and STRANGE, J.

MEMORANDUM OPINION

On May 17, 2010, the trial court entered an order assessing monetary sanctions against relators — Jon Justice, Jason Justice, Uvalde Truck Trailer, L.L.C., and J Way, L.L.C. — for discovery abuse. Relators filed this original mandamus proceeding challenging the sanctions. On July 1, 2010, we entered an order abating this proceeding. On October 25, 2010, we filed a clerk's record containing the trial court's October 20, 2010 order vacating its May 17 order. Therefore, the matters raised in this original proceeding are moot, and relators' petition for writ of mandamus is dismissed.
