In the Interest of J.M.I., a Child
ORDER Trial court case number: 2015-05008J Trial court: 313th District Court of Harris County
Appellants have filed a notice of appeal of appeal of a "Final Decree of Termination," signed on September 27, 2016. The reporter's record initially was due in this case on October 27, 2016. On October 26, 2016, court reporter Jill Bartek notified the Court that appellants had requested preparation of the reporter's record but had not paid, or made arrangements to pay, for the record and were not appealing as indigent. Ms. Bartek also notified the Court that two other court reporters, Cassie Pope and Krista Hall, were involved in the appeal. The court reporters have now notified the Clerk of this Court that appellants have paid, or made arrangements to pay, for the reporter's record. And, Ms. Bartek has filed a motion for an extension of time to file the reporter's record. The motion, filed on November 9, 2016, is granted. The reporter's record is due to filed in this Court no later than Monday, November 14, 2016. See TEX. R. APP. P. 28.4(b)(2).
Because this appeal involves the termination of the parent-child relationship, the Court is required to bring the appeal to final disposition within 180 days of October 17, 2016, the date the notice of appeal was filed in this proceeding, so far as reasonably possible. See Tex. R. Jud. Admin. 6.2, reprinted in Tex. Gov't. Code Ann., tit. 2, subtit. F app. (West 2013); see also TEX. R. APP. P. 28.4(a)(1), (2)(A). Accordingly, no extensions will be granted absent extraordinary circumstances.
The motion for an extension of time to file the reporter's record, filed on October 26, 2016, is dismissed as moot.
