Before the Court is appellant's notice of nonsuit which we construe as a motion to dismiss because he no longer desires to pursue this appeal. We grant the motion and dismiss the appeal. See Tex. R. App. P. 42.1(a)(1).

JUDGMENT

Justices Myers and Molberg participating.

In accordance with this Court's opinion of this date, the appeal is DISMISSED.

It is ORDERED that appellee Kira Butler recover her costs of this appeal from appellant Joseph McGinnis.
