Appellant appeals from the trial court's order denying his application for writ of habeas corpus. The order recites that the trial court considered "the argument and authorities contained in Applicant's Memorandum of Law, and certified exhibits appendixed [sic] and incorporated therein." Before the Court is appellant's November 28, 2022 motion for an extension of time to file his brief and supplement the record. Appellant asserts the record is incomplete because the trial court has not filed findings of fact and conclusions of law. Appellant filed a timely request for findings of fact and conclusions of law and notice of past due findings of fact and conclusions of law. See Tex. R. Civ. P. 296, 297. Accordingly, we GRANT appellant's motion as follows. We ORDER the Honorable Andrea Martin, Presiding Judge of the 304th Judicial District Court, to make written findings of fact and conclusions of law on or before January 17, 2023.

We ORDER Dallas County District Clerk Felicia Pitre to file, on or before January 23, 2023, a supplemental clerk's record containing the trial court's written findings of fact and conclusions of law. Appellant's brief on the merits will be due thirty days after the requested supplemental clerk's record is filed.

We DIRECT the Clerk of this Court to send appellant a paper copy of the supplemental clerk's record filed in this Court on December 19, 2022 and paper copy of the requested supplemental clerk's record when it is filed.

We further DIRECT the Clerk of this Court to send a copy of this order to Judge Martin; Ms. Pitre; and, all parties.
