ORDER MODIFYING OPINION

THE COURT:

It is ordered that the opinion filed herein on December 3, 2008, be modified as follows:

1. On page 2, the second full paragraph beginning "Appellant appeals from" is deleted and the following paragraph is inserted in its place:

Appellant appeals from the orders sustaining the petition and adjudging him to be a ward of the court, contending that there is insufficient evidence to support the juvenile court's finding that he committed first degree burglary.

There is no change in judgment.
