JUDGMENT DETERMINING EXCEPTION FROM DISCHARGE


On May 21, 2009, a preliminary pre-trial conference was held. The plaintiff appeared personally and by counsel George P. Galanos; the defendant appeared personally, pro se.

The court determines that the prayer for relief stated in the complaint is correct, and that if a summary judgment or other dispositive proceeding were filed by the plaintiff, there would be no genuine issue of material fact and the plaintiff would be entitled to judgment as a matter of law. The court determines that the $5,000.00 amount awarded to Colette Jen in paragraph 14 of the Agreement Respective Property Settlement, Custody, Support, Parenting Time, Attorney's Fees filed on May 1, 2008 in the Lake Circuit Court, Family Division, in case number 45C01-0608-DR-00601 is excepted from discharge by operation of 11 U.S.C. § 523(a)(5).

IT IS ORDERED, ADJUDGED AND DECREED that the $5,000.00 amount awarded to Colette Jen in paragraph 14 of the Agreement Respective Property Settlement, Custody, Support, Parenting Time, Attorney's Fees filed on May 1, 2008 in the Lake Circuit Court, Family Division, in case number 45C01-0608-DR-00601 is excepted from discharge by operation of 11 U.S.C. § 523(a)(5).
