ORDER ON MOTION FOR EN BANC RECONSIDERATION

Amparo Monique Guerra, Judge Acting for the En Banc Court

On August 31, 2023, the Court issued an opinion denying the petition for writ of mandamus of relator, J.B. Black. On October 2, 2023, Black filed a motion for en banc reconsideration of the Court's August 31, 2023 opinion. See Tex. R. App. P. 49.1, 52.9.

The en banc court has unanimously voted to deny Black's motion for rehearing en banc as untimely. See Tex. R. App. P. 49.1 ("A motion for rehearing may be filed within 15 days after the court of appeals' judgment or order is rendered."), 49.5 ("A party may file a motion for en banc reconsideration as a separate motion, with or without filing a motion for rehearing. The motion must be filed within the time prescribed by Rule 49.1 for filing a motion for rehearing."). It is ordered that the motion is denied.

En banc court consists of Chief Justice Adams and Justices Kelly, Goodman, Landau, Hightower, Countiss, Rivas-Molloy, Guerra, and Farris.
