ORDER MODIFYING OPINION AND DENYING REHEARING

THE COURT:

It is ordered that the opinion filed herein on October 5, 2011, be modified as follows: On page 5, the text of footnote 1 is deleted and replaced with the following: “Because the record was not developed as to the curfew violation being a basis for the detention, we do not address whether the curfew violation could have properly factored into the officers’ decision to detain Javier F.”

There is no change in judgment. Respondent’s petition for rehearing is denied.
