143 Cal.App.4th 717a __ Cal.Rptr.3d __ In re JAIME MEJIA JASSO, on Habeas Corpus. H029756 California Court of Appeal, Sixth District, October 11, 2006

Monterey County Super. Ct. No. SS021615.

THE COURT:

OPINION

RUSHING, P.J.

It is ordered that the opinion filed herein on September 12, 2006 (142 Cal.App.4th 1225;__ Cal.Rptr.3d__ ), be modified as follows:

1. On page 6, [142 Cal.App.4th 1233, advance report, 4th full par., line 8] line 23, the word “sox” is changed to “socks” so the sentence reads: The foot shackles hurt his ankles and caused them to bleed on the white socks that he had to wear.

2. On page 19, line 9, [142 Cal.App.4th 1244, advance report, 1st full par., line 2] the words “Attorney General” is changed to “Director of the Department of Corrections and Rehabilitation” so the sentence reads:We issue an order to show cause returnable before the superior court directing the Director of the Department of Corrections and Rehabilitation to show cause why defendant’s remaining convictions for transporting controlled substances should not be reversed due to ineffective assistance of counsel based on counsel’s failure to object to the shackles and prison garb.

There is no change in the judgment.

Premo, J., and Elia, J., concurred.
