MEMORANDUM OPINION


In this forcible detainer action, relator, Maryam Jamilah, has filed a petition for writ of mandamus complaining of the "Order Vacating Prior Judgment and Final Judgment Nunc Pro Tunc" signed by Judge James Blackstock on August 26, 2005, which ordered, inter alia, that a writ of possession would issue the sixth day on or after the judgment nunc pro tunc was signed.

The Honorable James Blackstock, presiding judge of the County Court at Law No. 3, Brazoria County. The underlying lawsuit is Washington Mutual Bank FA, as Servicing Agent for Wachovia bank, N.A. (f/k/a)First Union National Bank As Trustee for Long Beach Mortgage Loan trust 2000-1, Its Successors and Assigns v. Jamilah, No. CI 032913 (County Court at Law No. 3, Brazoria County, Tex.).

We deny relators' petition for a writ of mandamus. We deny relator's motion for emergency relief.
