Opinion

No. 05-07-01140-CV

Opinion issued September 13, 2007.

Original Proceeding from the 298th Judicial District Court, Dallas County, Texas, Trial Court Cause No. DC-06-10949.

Before Justices MOSELEY, BRIDGES, and FRANCIS.

MEMORANDUM OPINION

In his petition for writ of mandamus, relator complains that the trial court should not have placed his case on the jury docket. Based on the record before us, we conclude relator has failed to show the trial court clearly abused its discretion. See Tex. R. App. P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus. See Tex. R. App. P. 52.3.
