ORDER

Abigail D. James ("Mother") has filed a petition against Dennis Martin ("Father") for an Order of Custody and Visitation involving their daughter, Samantha A. James ("Samantha").

This case began with Father filing a Petition for Custody and Mother filing an answer and counterclaim. Father's Petition for Custody was dismissed for failure to complete his parent education course. --------

Father has been incarcerated in the State of Pennsylvania since Samantha was one year old. He is serving a nine to 18 year sentence on convictions of two counts of Aggravated Assault, one count of Reckless Endangering, and one count of Possession of an Instrument during a Crime.

After considering the evidence presented and for the reasons set forth on the record at the conclusion of the hearing,

IT IS ORDERED that Abigail D. James shall have sole legal custody and physical placement of Samantha A. James.

IT IS FURTHER ORDERED that Father shall have such visitation as agreed to by Mother. Mother shall provide to Father, by letter on a semi-annual basis, a report as to Samantha's health, significant developments in her life, and a current photograph of Samantha. The first report shall be due on May 1, 2017 and every six months thereafter.
