ORDER

ROBERT D. BURNS, III CHIEF JUSTICE

Before the Court is appellant's September 13, 2023 "motion for dismissal." The motion, however, does not seek dismissal of the appeal but argues the merits of the appeal and seeks reversal of the trial court's judgment. Accordingly, we CONSTRUE the motion as appellant's brief.

We note the brief was filed prematurely, as the reporter's record has not been filed. See Tex. R. App. P. 38.6 (appellant's brief in regular appeal due within thirty days after the later of the filing of the clerk's record or the filing of the reporter's record). We also note the brief does not comply with the briefing requirements of the Texas Rules of Appellate Procedure. See id. 9.5 (service), 38.1 (contents of an appellant's brief). We, therefore, STRIKE the brief. Appellant shall file a brief complying with the appellate rules within thirty days of the filing of the reporter's record.
