ORDER

Michael F. Gadola, Chief Judge Pro Tem, acting under MCR 7.211(E)(2), MCR 7.217, and MCR 7.219(I), orders:

The motion to extend time to file respondent-appellee's brief is DENIED as moot because the brief was not filed by the requested extension date of December 15, 2023.

Further, in light of the warning provided in the letter sent by the Clerk's Office on November 21, 2023, this case is REMANDED to the trial court for appointment of substitute counsel for respondent-appellee within 21 days after the date of this order, current counsel having failed to timely file respondent-appellee's brief. Pursuant to this Court's September 21, 2023 order substitute counsel shall file a brief on appeal for respondent-appellee. The time for substitute counsel to file respondent-appellee's brief under MCR 7.212(A)(2)(a)(i) shall run from entry of the order appointing substitute counsel.

Michael Horowitz (P81489), appointed counsel for respondent-appellee, shall pay to the Clerk of this Court, within 21 days after the date of this order, costs in the sum of $250. Such costs are personal to the attorney and shall not be charged back to the county or to the state.
