MEMORANDUM OPINION


In our July 12, 2004 order, we concluded the trial judge did not abuse his discretion in sustaining the district clerk's contest of Shawn Eric McGee's affidavit of indigency. We ordered McGee to remit the $125 filing fee due in this appeal and to provide written documentation to the Court that he had made payment arrangements to pay for the clerk's record. We cautioned McGee that the failure to file the necessary filing fee and the required documentation on or before August 2, 2004 would result in the dismissal of this appeal for want of prosecution, without further notice from this Court.

To date, the Court has not received the $125 filing fee or written documentation that McGee has made payment arrangements to pay for the clerk's record. Accordingly, we DISMISS this appeal for want of prosecution. See Tex.R.App.P. 37.3(b).
