IN THE INTEREST OF M.L.R.S., A CHILD
On Appeal from the 309th District Court Harris County, Texas
Trial Court Cause No. 2019-70099
ORDER
Appellant has filed a motion to extend time to file a brief on the grounds that the reporter's record has not been filed. On November 30, 2020, the clerk of this court notified appellant that we would consider and decide those issues that do not require a reporter's record unless appellant, within 15 days of notice, provided this court with proof of appellant's request for the reporter's record. See Tex. R. App. P. 37.3(c). No response was received. Accordingly, on December 29, 2020, appellant was ordered to file a brief within 30 days. No brief was filed.
On January 27, 2021, appellant filed a motion to extend time to file the reporter's record. Although no proof of appellant's request for the reporter's record was filed, the extension was granted.
On March 2, 2021, the court reporter informed this court that appellant was appealing as indigent, although he has not been determined indigent, and appellant had not requested that the reporter's record be prepared and the trial court had not ordered the record be prepared. On April 5, 2021, appellant filed this motion. Again, no proof of appellant's request for the reporter's record was filed.
Unless, within 10 days of the date of this order, appellant provides this court with proof that appellant has requested the court reporter, Mekailah McChriston, to prepare and file the reporter's record, we will consider and decide those issues that do not require a reporter's record.
PER CURIAM Panel Consists of Justices Bourliot, Poissant, and Wilson.
