The court grants en banc reconsideration of the second issue raised in the Department of Family and Protective Services's motion for reconsideration en banc: whether "[e]ven if legally insufficient, this case should be remanded for a new trial." Accordingly, the panel's judgment will not become final, and the issue of the disposition of the case will be resubmitted to the court for en banc review on December 23, 2020.
