IN RE INSURANCE OFFICE OF AMERICA, INC. AND STEPHEN MCCORD, Relators

Original Proceeding from the 101st Judicial District Court Dallas County, Texas Trial Court Cause No. DC-23-04058

Before Justices Pedersen, III, Nowell, and Miskel

MEMORANDUM OPINION

EMILY MISKEL, JUSTICE

In this original proceeding, relators seek mandamus relief from two discovery rulings: (1) the trial court's Order Denying Omnibus Motion to Quash Defendant CoVerica's Subpoenas Duces Tecum and for Protective Order and (2) the trial court's Order Granting CoVerica's Motion to Compel. Entitlement to mandamus relief requires relators to show that the trial court clearly abused its discretion and that they lack an adequate appellate remedy. In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004) (orig. proceeding).

After reviewing relators' petition, real party in interest's response, the reply, and the record before us, we conclude that relators have failed to demonstrate that the trial court abused its discretion. Accordingly, we deny the petition for writ of mandamus. See TEX. R. APP. P. 52.8(a). We also lift our stay order dated December 11, 2023.
