The court is in receipt of appellee's response to this court's order dated May 11, 2018. This court's opinion and judgment were issued in this appeal on February 28, 2018. As a result, any motion for rehearing was due to be filed by March 15, 2018. TEX. R. APP. P. 49.1. This court granted appellee an extension of time to file a response to appellant's motion to release supersedeas bond, but this court did not grant appellee an extension of time to file a motion for rehearing.
Appellee filed a timely motion for en banc reconsideration on March 14, 2018, which this court denied on March 27, 2018. Appellee filed an untimely motion for reconsideration on April 12, 2018. Because the motion for reconsideration was untimely filed, the motion was denied in this court's May 11, 2018 order.
The reference to a filing date of April 13, 2018 in this court's May 11, 2018 order was a typographical error.
