APPELLANT'S MOTION FOR DISMISSAL OF KEITH REISLER'S APPEAL
Appellant, Keith Reisler, asks the Court for a dismissal of Appellant Keith Reisler's appeal.
A. Introduction
1. Appellant is Keith Reisler and Cathie Reisler and Appellee is Paul French.
2. Appellant perfected the appeal on November 20, 2012, when he filed a notice of appeal.
B. Argument
3. The Court has the authority under Texas Rule of Appellate Procedure 42.1(a)(1) to grant this motion for dismissal.
4. Appellant, Keith Reisler has reached an agreement to compromise and settle his differences regarding any disputes over the monies owed to Paul French in suit styled "In the Matter of the Marriage of Keith Reisler and Cathie Reisler and in the Interest of Jenna Reisler and Julia Reisler, Minor Children, Cause Number 416-50508-2010. This was the only portion of the case Keith Reisler was wishing to appeal.
5. Keith Reisler asks the Court to abate the appeal and permit proceedings in the trial court to effectuate the agreement. Tex. R. App. P. 42.1(a)(1)(C).
6. Keith Reisler asks the Court to dismiss his appeal. The dismissal of Keith Reisler's appeal will not prejudice any remaining parties or other parts of the appeal. Tex. R. App. P. 42.1(b).
C. Prayer
7. For these reasons, Keith Reisler asks the Court to grant this motion to dismiss.
