MEMORANDUM OPINION

Jeff Lay is appealing from the trial court's "Final Decree of Divorce," which was signed on June 22, 2017. Lay timely filed a motion for new trial; therefore, his notice of appeal must have been filed within ninety days after the judgment was signed, i.e., by September 20, 2017, see TEX. R. APP. P. 26.1(a), or a motion for extension of time to file notice of appeal must have been filed within fifteen days after the deadline for filing the notice of appeal, i.e., by October 5, 2017. See TEX. R. APP. P. 26.3. Lay's notice of appeal was filed on October 6, 2017, and was therefore untimely filed.

The Clerk of the Court notified Lay that we would dismiss this appeal unless he filed a response showing grounds for continuing the appeal. Lay has not responded. We therefore dismiss this appeal. See TEX. R. APP. P. 42.3(a), (c).
