CONTINUING ABATEMENT ORDER
This appeal is from a judgment signed July 20, 2015. Appellant filed a notice of appeal on September 3, 2015. On November 25, 2015, the Fort Bend County Clerk notified this court that appellant had not made payment arrangements for the clerk's record. The court reporter filed a request for extension of time noting that appellant is appealing as indigent. On December 2, 2015, this court ordered the trial court to conduct a hearing to determine whether appellant is entitled to proceed without payment of costs.
The court asked the trial court to make appropriate findings and recommendations, prepare a record of the proceedings, and transmit the record of the hearing to our court on or before January 4, 2016. No records were filed.
The appeal is abated, treated as a closed case, and removed from this court's active docket. The appeal will be reinstated on this court's active docket when the trial court's findings and recommendations are filed in this court. The court will also consider an appropriate motion to reinstate the appeal filed by either party. It is the responsibility of any party seeking reinstatement to request a hearing date from the trial court and to schedule a hearing in compliance with this court's order. If the parties do not request a hearing, the court coordinator of the trial court shall set a hearing date and notify the parties of such date.
