IN THE INTEREST OF I.F., E.F., AND F.F., CHILDREN
On Appeal from the 255th Judicial District Court Dallas County, Texas Trial Court Cause No. DF-19-21932
ORDER
BONNIE LEE GOLDSTEIN JUSTICE
The reporter's record in this appeal has not been filed. It was initially due on September 30, 2021. On October 11, Court Reporter Yolanda Atkins informed the Court why the record had not been filed, and we subsequently reset the deadline for filing the record to December 30. Ms. Atkins did not communicate with the Court again until we issued an order cautioning her that if she did not file the record by February 22, 2022, we may direct the trial court to conduct a hearing to determine why the record has not been filed. Instead of filing the record by February 22, Ms. Atkins has filed a further extension motion explaining that she needs a further extension because her home has incurred water damage and she is awaiting construction and plumbing repairs. We DENY the motion.
We ORDER the trial court to conduct a hearing, no later than March 16, 2022, to determine the date the record will be filed and what steps need to be taken to ensure it is filed by that date. To that end, Ms. Atkins and LaToya Young, Official Court Reporter for the 255th Judicial District Court, shall be present at the hearing.
The trial court shall make written findings concerning the solution to getting the record filed with this Court. The findings shall be filed in a supplemental clerk's record no later than March 22, 2022. A supplemental reporter's record of the hearing shall also be filed no later than March 22, 2022.
We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Kim Cooks, Presiding Judge of the 255th Judicial District Court; Dallas County District Clerk Felicia Pitre; Ms. Atkins; Ms. Young; and, all parties.
We ABATE the appeal to allow the trial court an opportunity to conduct the hearing. The appeal will be reinstated no later than March 24, 2022.
