MEMORANDUM OPINION

The underlying case is Edgar L. Hull, Jr. v. South Coast Catamarans, L.P., Aksano Catamarans, L.L.C., and James Babcock, Individually, No. 08CV0236 in the 212th Judicial District Court of Galveston County, Texas, the Hon. Susan Criss, presiding.


By petition for writ of mandamus, relator, Edgar L. Hull, Jr., challenges the trial court's order granting a motion for new trial.

We deny the petition for writ of mandamus. All pending motions are denied as moot.
