The Court has before it relator's May 9, 2016 petition for writ of habeas corpus and request for temporary relief. We GRANT the request for temporary relief. Pending this Court's determination of relator's petition on the merits, and until further order of this Court, we ORDER that relator Alejandro Huitrado-Soto be released from custody of the Sheriff of Dallas County, Texas only upon posting a good and sufficient cash or surety bond, conditioned as required by law, in the sum of $1,200, plus all expenses which may be incurred by peace officers in rearresting relator in the event that relator fails to appear at any hearing before this Court or violates some other condition of the bond.
In the event that relator Alejandro Huitrado-Soto gives such bond, the Sherriff of Dallas County, Texas is ORDERED to immediately forward a certified copy of the bond to the Clerk of this Court. This order releases relator Alejandro Huitrado-Soto from custody only under the "Order Holding Alejandro Huitrado-Soto in Contempt for Failure to Pay Child Support and Arrearages, Granting Judgment for Arrearages, and Suspending Commitment" dated February 29, 2016 issued by the 254th Judicial District Court of Dallas County, Texas in cause number DF-14-01954-R.
The Court requests that real party in interest and respondent file a response, if any, on or before May 20, 2016.
The Court DIRECTS the Clerk to send copies of this order, by electronic transmission, to the Honorable Susan Rankin, Presiding Judge, 254th Judicial District Court; Lupe Valdez, Dallas County Sherriff; and to counsel for all parties.
