In re Heath Howeth
ORIGINAL PROCEEDING FROM HAYS COUNTY
ORDER
PER CURIAM
Relator Heath Howeth filed a petition for writ of mandamus asking this Court to direct the trial court to vacate its order granting a motion to compel and directing Howeth to produce his tax returns and supporting material. See Tex. R. App. P. 52.1. We denied the petition for writ of mandamus because we concluded that the mandamus record, which lacked the order granting the motion to compel, was insufficient for us to grant relief. See id. R. 52.8. Howeth has now filed a motion for reconsideration along with a supplemental appendix containing a certified copy of the trial court's order granting the motion to compel and a certified copy of the reporter's record of the hearing resulting in the order. Howeth has also filed a second motion for emergency relief asking us to stay the trial court's order and a second motion for expedited consideration of the motion for emergency relief. See id. R. 52.10.
We grant Howeth's motion for reconsideration in part and reinstate his petition for writ of mandamus. We grant the motion for emergency relief and temporarily stay the trial court's April 24, 2017 order granting the motion to compel, pending further order of this Court. We dismiss the motion for expedited consideration of the motion for emergency relief as moot. The Court orders the real parties in interest, Knight's Crossing, Ltd. and Paul Albini, to file a response to the petition for writ of mandamus on or before May 30, 2017.
It is so ordered May 18, 2017. Before Chief Justice Rose, Justices Field and Bourland
