Opinion

No. 05-03-01624-CV

Opinion Issued November 21, 2003.

Original Proceeding from the 192nd Judicial District Court Dallas County, Texas, Trial Court Cause No. 02-12100-K.

Before Justices WHITTINGTON, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator contends the trial judge erred in denying its motion to compel arbitration of the claims of Patricia Von Bargen under the federal arbitration act. The facts of this original proceeding are known to the parties so we do not recite them here. Based on the record presented, we conclude relator has failed to show it is entitled to the relief requested from this Court. Accordingly, relator's petition for writ of mandamus is DENIED. See Tex. R. App. P. 52.8(a). The Court VACATES the stay order issued November 7, 2003.
