Opinion

No. 05-05-01413-CV

Opinion issued October 19, 2005.

Original Proceeding from the Criminal District Court No. 5, Dallas County, Texas, Trial Court Cause No. F04-49745-WL.

Writ of Mandamus Dismissed.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator contends the trial court violated a ministerial duty by denying relator's first motion to recuse, refusing to rule on relator's second motion to recuse, and refusing to refer the motion to the administrative judge pursuant to Texas Rule of Civil Procedure 18a. See Tex. R. Civ. P. 18a(c). We have received a copy of the trial judge's order recusing himself from the underlying case. Therefore, this original mandamus proceeding is now moot. We dismiss relator's petition for writ of mandamus as moot.
