No. 05-07-00785-CV
Opinion issued July 2, 2007.
Original Proceeding from the 422nd Judicial District Court Kaufman County, Texas Trial Court Cause No. 67-427-422.
Before Justices MOSELEY, BRIDGES, and FRANCIS.
MEMORANDUM OPINION
In his petition for writ of mandamus, petition for writ of prohibition, and his "emergency petition for stay of order of contempt and for writ of prohibition," relator complains that the trial court has erred in finding him in contempt of a temporary injunction. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.7; 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding).
Additionally, this Court may issue a writ of prohibition necessary to enforce its jurisdiction. See Tex. Gov't Code Ann. § 22.221(a) (Vernon 2004). Because we do not have actual jurisdiction over a pending proceeding in this case, our jurisdiction is limited to mandamus authority. See In re Nguyen, 155 S.W.3d 191, 194 (Tex.App.-Tyler 2003, orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus, petition for writ of prohibition, and his "emergency petition for stay of order of contempt and for writ of prohibition."
