          [PROPOSED] ORDER GRANTING PLAINTIFFS' MOTION FOR SUMMARY ADJUDICATION OF ISSUES AGAINST DEFENDANT VIRGIL LIM

          DICKRAN TEVRIZIAN, District Judge.

         Plaintiffs' motion for partial summary judgment came on regularly before this Court on June 28, 2004. Brian Barry of the Law Offices of Brian Barry appeared as counsel for Class Plaintiffs, Roman P. Mosqueda of the Law Offices of Roman P. Mosqueda appeared for defendant Virgil Lim.

         After considering the moving and opposition papers, oral arguments of counsel and all other matters presented to the Court,

         IT IS HEREBY ORDERED that the findings of fact and conclusions of law set forth in the Statement of Uncontroverted Facts and Conclusions of Law filed by Class Plaintiffs are without substantial controversy and are deemed established for purposes of trial.
