IN RE TERRY HELMCAMP

Original Proceeding 435th District Court of Montgomery County, Texas
Trial Cause No. 12-01-00757-CR

MEMORANDUM OPINION

Terry Helmcamp, Relator, seeks a writ of mandamus directing the trial court to grant a motion for DNA testing. Relator complains that no action has been taken by the trial court on a motion he filed on March 18, 2016, and as to objections that were filed on May 25, 2016.

Relator has not shown that the trial court delayed its disposition of the motion for DNA testing for an unreasonable length of time. See In re Bates, 65 S.W.3d 133, 134-35 (Tex. App.-Amarillo 2001, orig. proceeding) (discussing factors to consider in evaluating whether a trial court failed to act within a reasonable time). We deny the petition without prejudice.

PETITION DENIED.
