IN RE SEAN HEIDRICH

Original Proceeding
418th District Court of Montgomery County, Texas
Trial Cause No. 20-01-00492-CV

ORDER

Relator Sean Heidrich filed a petition for writ of mandamus. Relator is the petitioner in a divorce action filed against the real party in interest. Relator seeks a writ compelling the Honorable Tracy Gilbert to rule upon the parties' joint motion to conduct trial via Zoom due to the Covid-19 pandemic. On July 21, 2020, this Court stayed the July 22, 2020 trial setting while we considered the merits of the mandamus petition. On July 27, 2020, the Respondent asked this Court to clarify our order to allow a telephone conference.

Our order of July 21, 2020, which temporarily stayed the trial setting of July 22, 2020, is hereby amended to permit Respondent to set the Joint Motion to Conduct Trial and Motion to Enter Final Decree of Divorce as Written Hearing via Zoom for a telephone conference, to conduct a telephone conference or other remote proceeding, and to set the Motion to Enter Agreed Final Decree of Divorce for a date and time certain. Any party to this original proceeding may file a motion to reconsider this Court's temporary order if the trial court fails to adequately address the concerns raised in the parties' joint motion. The temporary relief is granted without regard to the merits of the mandamus petition.

ORDER ENTERED July 28, 2020.

PER CURIAM Before McKeithen, C.J., Kreger and Horton, JJ.
