DECISION & ORDER ON MOTION FOR REINSTATEMENT

Motion by Genaro R. Hathaway for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Hathaway was admitted to the Bar in the State of New York at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 17, 1990. By opinion and order of this Court dated September 29, 2009, Mr. Hathaway was disbarred, effective immediately, and his name was stricken from the roll of attorneys and counselors-at-law.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied.

We find that Genaro R. Hathaway does not demonstrate the requisite character and fitness to practice law.
