THIS CAUSE came on for consideration upon the Court's own Motion for the purpose of entering a Final Judgment in the above-captioned adversary proceeding. The Court has considered the record and finds that this Court has entered Findings of Fact, Conclusions of Law and Memorandum Opinion. Therefore, it appears appropriate to enter Final Judgment.
Accordingly, it is
ORDERED, ADJUDGED AND DECREED that as to Counts I and II of the Second Amended Complaint, Final Judgment be, and the same is hereby, entered in favor of the Defendant, Roger W. Harloff, and against the Plaintiff, Lease Corporation of America. Both Counts are hereby dismissed with prejudice. It is further
ORDERED, ADJUDGED AND DECREED that the debt owed by Defendant, Roger W. Harloff, to Plaintiff, Lease Corporation of America, be, and the same is hereby, not within the exceptions of 11 U.S.C. § 523 (a)(2)(B) or § 523 (a)(6), and therefore is dischargeable.
