THE COURT:

It is ordered that the opinion filed herein on November 14, 2003, and not certified for publication be modified as follows:

On the title page, please delete the reference to Attorney Gary M. Diamond as a court-appointed counsel for Respondent. Hence, line 6 should read: Gary M. Diamond for Respondent.

The petition for writ of supersedeas, filed June 23, 2003, is dismissed as moot. The temporary stay order, filed June 26, 2003, is vacated.

There is no change in judgment.
