LC No. 20-003323-NA

Brock A. Swartzle Presiding Judge, Michael J. Kelly, Michelle M. Rick Judges

ORDER

The motion to withdraw is DENIED for reasons that the appeal is not wholly frivolous. Counsel for defendant-appellant shall have 21 days from the Clerk's certification of this order within which to file appellant's brief on appeal addressing the following issues: (1) whether the circuit court erred in requiring respondent to provide evidence that her consumption of THC either improved or had no impact on her ability to provide proper care and custody of the minor children; and (2) whether respondent's consumption of THC "creates an unreasonable danger to the minor[s] that can be clearly articulated and substantiated." MCL 333.27955.

The Clerk is directed to place this case on the next available case call after the expiration of the time to file appellee's brief.
