MEMORANDUM OPINION


Appellee Douglass D. Hearne has filed a motion to dismiss himself from this appeal, stating that he and appellant have resolved the claims against him pursuant to settlement. In his certificate of conference, Hearne states that Appellant Sherri Archer Loveday does not oppose the relief requested in his motion. We, therefore, grant Hearne's motion to dismiss. See Tex.R.App.P. 42.1(a). The appeal of Appellant Sherri Archer Loveday with respect to the other appellees remains pending under this cause number.
