This proceeding arises out of Cause No. 2015CI02215, styled Ramon Ortiz, Individually and as Executor of the Estate of Magda Ortiz, Deceased; Sergio Bernier; and Magda Bernier v. The University of Texas System v. The Robins & Morton Group; Robins & Morton Corporation; Robins & Morton, L.L.C.; SmithGroup/Marmon Mok, A Joint Venture; Marmon Mok; and Marmon Mok, LP, pending in the 45th Judicial District Court, Bexar County, Texas, the Honorable Solomon Casseb III presiding. --------

On January 28, 2016, relators filed a petition for writ of mandamus and emergency motion for immediate temporary relief. This court is of the opinion that a serious question concerning the mandamus relief sought requires further consideration. See TEX. R. APP. P. 52.8(b). The respondent and the real parties in interest may file a response to the petition for writ of mandamus in this court no later than February 19, 2016. Any such response must conform to Texas Rule of Appellate Procedure 52.4.
Relators' request for emergency relief is GRANTED. The current trial setting of February 8, 2016, in Cause No. 2015CI02215, styled Ramon Ortiz, Individually and as Executor of the Estate of Magda Ortiz, Deceased; Sergio Bernier; and Magda Bernier v. The University of Texas System v. The Robins & Morton Group; Robins & Morton Corporation; Robins & Morton, L.L.C.; SmithGroup/Marmon Mok, A Joint Venture; Marmon Mok; and Marmon Mok, LP, pending in the 45th Judicial District Court, Bexar County, Texas, is TEMPORARILY STAYED pending further order of this court.
