MEMORANDUM OPINION
PER CURIAM
Larry Wayne Gross, incarcerated and acting pro se, has filed a petition for writ of mandamus compelling the trial court to rule on (1) a motion by real party in interest to dismiss the underlying case filed by Gross for lack of jurisdiction and (2) a motion by Gross for summary judgment. We deny the petition.
The underlying case is Larry Wayne Gross v. Rene Hinojosa, cause number 112110-I, pending in the 239th District Court of Brazoria County, Texas, the Honorable Patrick Sebesta presiding.
