This judicial disciplinary action against Respondent was resolved by an order issued by this Court approving the parties’ conditional agreement for discipline, permanently banning Respondent from judicial service, and suspending Respondent from the practice of law for a period of one year, beginning January 15, 2021, with 90 days actively served and the remainder stayed subject to successful completion of at least two years of probation.
On April 5, 2021, the Indiana Commission on Judicial Qualifications filed its "Verified Notice of Violation, Request for Suspension Pending Revocation, and Motion to Revoke Probation ("Notice"), alleging that Respondent violated the terms of his probation. On April 9, 2021, we issued an order requiring Respondent to respond to the allegations and to show cause, if cause exists, why he should not be immediately suspended from the practice of law pending final resolution of these probation revocation proceedings. Respondent has not filed a response within his deadline for doing so. Accordingly, the allegations in the "Notice" are deemed admitted. See Admis. Disc. R. 23(16)(c)(2).
Being duly advised, the Court now suspends Respondent from the practice of law, effective immediately, pending final resolution of the Commission's "Notice." See Admis. Disc. R. 23(16)(e). The parties each may file, within thirty (30) days of this order, a brief addressing the sanction this Court should impose as a result of Respondent's violation of the terms of his probation. Following expiration of this period, the Court will enter a final disposition of this matter.
