Relator, through counsel, has filed a motion for leave to file an application for a writ of mandamus pursuant to the original jurisdiction of this Court. In it, he contends that this Court should exercise its mandamus power to compel the trial court to dismiss three indictments in accordance with this Court's prior decisions in Relator's habeas applications. See Ex parte Gray, Nos. 82,772-01, -02, and -03 (Tex. Crim. App. Feb. 24, 2016) (Yeary, J., filed a dissenting opinion) (not designated for publication); Braxton v. Dunn, 803 S.W.2d 318, 320 (Tex. Crim. App. 1991). Relator states that, although many attempts have been made to have orders of dismissal signed, the trial court declines to do so. There is no response from the trial court in the mandamus material provided to this Court.

Respondent, the Judge of the 241st District Court of Smith County, shall file a response with this Court. Respondent's answer shall be submitted within 30 days of the date of this order. This application for leave to file a writ of mandamus will be held in abeyance until Respondent has submitted his response. Filed: June 7, 2017
