Opinion

No. 05-05-01343-CV

Writ of Mandamus Denied, Opinion issued October 12, 2005.

Original Proceeding from the 134th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 03-02547-G.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator filed petitions for writ of mandamus and writ of certiorari asking this Court to order the trial court to set aside a judgment against him. The petitions are identical except for the caption. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus. We DISMISS for lack of jurisdiction relator's petition for writ of certiorari.
