ORDER GRANTING AND APPROVING TRUSTEE'S FIRST INTERIM APPLICATION FOR AUTHORITY TO PAY FEES, AND APPROVE COSTS, OF TRUSTEE'S COUNSEL
Larry Compton, Trustee ("Trustee"), requested approval of Trustee counsel interim fees of $41,661.50 and costs of $2,547.21, for a total of $44,208.71, for the period of May 2, 2001, through March 12, 2004, and the Trustee requested approval to pay counsel for the Trustee the sum of $30,000 at this time, representing more than a twenty-five percent (25%) hold back. Notice of the application was sent to the mailing matrix and objections were filed by creditors Connie Bennett, Darryl Jordan and Cheri Jordan. A hearing was held on the application on June 14, 2004. Counsel for the Trustee, Michelle L. Boutin, appeared at the hearing; Connie Bennett appeared telephonically, and Darryl Jordan appeared as well. The Court has fully considered the application. The Court finds that the application for fees and costs is reasonable and further that the issues raised in the objections to the application were each addressed in the Trustee's Reply. Therefore,
Of the total, attorney fees in the amount of $14,466.50 and costs in the amount of $1,018.54 were generated by Bundy Christianson; attorney fees in the amount of $27,195 and costs in the amount of $1,528.67 were generated by Christianson, Boutin Spraker.
IT IS ORDERED that the Trustee's First Interim Application for Authority to Pay Fees, and Approve Costs of Trustee's Counsel, is GRANTED and APPROVED. Further, the Trustee may disburse an amount up to $30,000 at this time (representing more than a twenty-five percent hold back of the approved fees), subject to disgorgement in the event that the estate is not administratively solvent or becomes administratively insolvent.
