ON APPLICATION FOR A WRIT OF MANDAMUS FROM HARRIS COUNTY

Per curiam. ORDER

Relator has filed a motion for leave to file an application for a writ of mandamus under this Court's original jurisdiction. He contends that he is being held in the Harris County Jail and was not transferred to the Texas Department of Criminal Justice (TDCJ)-Correctional Institutions Division within forty-five days of the revocation of his parole. See TEX. GOV'T CODE § 499.121(c). He urges this Court to order Respondent, the Executive Director of TDCJ, to take custody of him.

Relator's motion for leave to file is denied. Relator has not presented a compelling reason why this Court should exercise its mandamus jurisdiction given that the trial court also has the authority to mandamus Respondent in his case. See TEX. CONST. art. V, § 8; TEX. GOV'T CODE § 24.011; Padilla v. McDaniel, 122 S.W.3d 805 (Tex. Crim. App. 2003). Filed: July 22, 2020
