IN RE GOLDSTAR AMUSEMENT, INC.

Original Proceeding 172nd District Court of Jefferson County, Texas Trial Cause No. E-0209867

Before Golemon, C.J., Johnson and Wright, JJ.

ORDER

PER CURIAM

Goldstar Amusement, Inc., Relator, filed a petition for a writ of mandamus and a motion for temporary relief. See Tex. R. App. P. 52. Relator is a defendant in Trial Cause Number E-0209867, Parent One, as Next Friend and Guardian of Minor Child One v. Elfranco Johannes Fourie and Goldstar Amusement, Inc. Relator seeks a writ compelling the Honorable Mitch Templeton, Judge of the 172nd District Court of Jefferson County, Texas, to vacate an order compelling the production of documents that Relator claims are privileged or irrelevant. See Tex. Gov't Code Ann. §22.221.

Relator requests that the trial court's order be stayed while this Court considers the mandamus petition. The Court finds temporary relief is necessary to prevent undue prejudice. It is ORDERED that the trial court's Order of February 19, 2024, in Trial Cause Number E-0209867, compelling Relator to respond to Requests for Production 8, 9, 10, 11, 65, 93, 112, 113, 114, 115, 116, and 117, and the discovery compelled by the trial court's order to respond to Requests for Production 8, 9,10,11, 65, 93,112,113,114,115,116, and 117, are STAYED until our opinion issues or until further order of this Court. See Tex. R. App. P. 52.10(b). No bond is required of Relator as a condition to any relief herein granted.

Relator has not challenged the trial court's order of February 19, 2024, to the extent that it compels Relator to respond to Interrogatories, to provide verifications to its Interrogatory answers, to provide depositions dates, or to respond to Requests for Production 2, 4, 5, 29, 30, 31, 41, 59, 61, 87, 89, 90, 91, 92, 94, 104, and 105. This Order does not stay the trial court's order of February 19, 2024, to the extent it compels Relator to respond to Interrogatories, to provide verifications to its Interrogatory answers, to provide depositions dates, or to respond to Requests for Production 2, 4, 5, 29, 30, 31, 41, 59, 61, 87, 89, 90, 91, 92, 94, 104, and 105.

The response of the Real Party in Interest, Parent One, is due March 11,2024.

MOTION FOR TEMPORARY RELIEF GRANTED.
