MOTION DECISION

Present - Hon. Sallie Manzanet-Daniels, Justice Presiding, Cynthia S. Kern Angela M. Mazzarelli Julio Rodriguez III Bahaati E. Pitt, Justices.

An order of this Court having been entered January 13, 2011, disbarring petitioner (who was admitted to practice as an attorney and counselor-at-law in the State of New York at a Term of the Appellate Division of the Supreme Court for the First Judicial Department on November 25, 1996), pursuant to Judiciary Law § 90(4)(b), as a result of his conviction on September 30, 2010, in Supreme Court, New York County, of the crime of identity theft in the second degree (PL § 190.79[3])(2 counts), a class E felony, effective nunc pro tunc to September 30, 2010, and until further order of this Court (M-5541), And petitioner, by his attorney Ezra B. Glaser, Esq., having moved this Court on September 27, 2021, for an order pursuant to Judiciary Law § 90(5)(a) and 22 NYCRR 1240.16, vacating the disbarment order of January 13, 2011 (M-5541), and reinstating him as an attorney and counselor-at-law in the State of New York, based on the reversal of his felony convictions, And the Attorney Grievance Committee, by Jorge Dopico, its Chief Attorney (Raymond Vallejo, Esq., of counsel), having submitted an affirmation, dated September 20, 2021, stating that it does not object to petitioner's motion, And the Lawyers' Fund for Client Protection having submitted a letter, dated August 25, 2021, stating that there are no open claims against petitioner seeking reimbursement from the Fund and no awards involving him, and therefore it has no objection to the relief sought, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, it is unanimously, Ordered that the motion is granted and the order of this Court, entered January 13, 2011 (M-5541), and the Opinion Per Curiam issued therewith, are hereby recalled and vacated and petitioner is reinstated as an attorney and counselor-at-law in the State of New York, effective the date hereof, and

It is further Ordered that petitioner is directed to immediately register with, and pay to, the Office of Court Administration any applicable registration fees in compliance with Judiciary Law § 468-a.
