ORDER
The Debtor, through counsel, filed a Disclosure Statement and Plan on July 9, 2013, along with a Motion for Conditional Approval of the Proposed Disclosure Statement. The Debtor then filed an amended Disclosure Statement on July 12, 2013. The Motion for Conditional Approval of the Proposed Disclosure Statement is DENIED and the Clerk is directed to set the Disclosure Statement for hearing on the following grounds: (1) Debtor's non-compliance with Local Rule 3017-2, (2) Debtor is not a "Small Business Debtor" as defined in 11 U.S.C. § 101(51D), and (3) Financial information regarding funding of the Plan in section III(D) of the Disclosure Statement ($5,500 per month rental income from White Properties) is inconsistent with projections made in Schedule F to the Disclosure Statement based on $8,000 per month rental income from White Properties.
The Clerk is directed to send a copy of this Order to the Debtor, counsel for the Debtor, the Office of the United States Trustee, and any other party having filed a notice of appearance or request to receive notice.
